So... I have received an account from the TDC for... "The non consumptive take and discharge of water"

Who else gets these, who pays them, who argues them, and what regions is this money grab being applied to?

Gidday Paul,
Was in Loas with the family breifly recently..looks like a great country to explore!

A few regions try this on. Technically there is no take, and if someone challenged it in court you probably have a better than 50:50 chance of winning.
Its a rort, there is no take, so why be hit by it.
I would try challenging it, and the manager there does not like an arguement. Will be happy to draft you a letter if you want...

Yes they are trying it on and I have told them I consider it a nonsense fee... Unless is applied equally to other recreational river users, I have no intention of paying. I know there is an attempt to also charge another claim holder who is in the permitted size limit so does not need resorce consent.

At the end of the day a jet boat fits the description as well... the non cunsumtive take and discharge...

I have no problems with a reasonable fee for administration of the consent, but this is just an attempted money grab.

Have already sent a letter...

What are others doing when they come accross this?

their argument might be that you are taking clean water and discharging dirty. not that paying a fee is going to stop that. typical govt. dept. any excuse to grab a bit of coin off you.

nafcd, they hit you with a consent for a take of water (and implied use) and a discharge of sediment to water..both are marginal. the later is simply resuspension of sediments already in the system, no discharge. the take is erroneous too.

the take can be more easily argued, and that has the fee associated with it.

Where I work, we operate under a "standard" water consent (As in the council has 'cut-n-pasted' it from an American publication - despite the fact that the natural stream pH is outside their limits, and our discharge is cleaner than the natural water...)

Under the consent conditions we must ensure that:
Discharged water does not alter the stream pH (not an issue with your application), and,
Discharged water does not alter the turbidity of the stream at 10m or greater from the discharge - again, I suspect that the material you're shoveling is very low in suspended particulates)

However, the material discharged must be less than 50NTU (water has a visual haziness to it as a guide)

I agree though, that (under the wording) a jet boat comes under the same category, and it is likely to be one of those fees that are waived for those who show intelligence, while others pay blindly.

I was pondering the "take"... after all water is not taken from the river... but the wording is "Water take ..Surface"

I am in for a good argument at the very least...

I got a letter from the Orc about that so I tossed it in the bin and never heard back from them !

G'day Phil ,How you doing? I went for a wander up the top end of your "claim" around the hut site. Detected two tiny bits of gold. Have you been doing any dredging up there?

How long ago did you chuck that letter in the bin?

Hi JW....tossed it around a year ago and haven't heard back....yep went up there on Friday for a few days dredging down in the gorge tiger country down in there lots of big stones !!

If I chucked mine it would only come back... it islinked to a resource consent.

But I have sent a letter to the TDC disputing the fee...

Write to the manager and advise it isnt a take. Tell him you will be prepared to take it further, or offer him a generous offer of you seeking a variation to the consent, happy to write it for you, and seek it be removed. of course, that will be without fee. Alternaitvely they could treat all non-consumtive takes i.e jetboats and hydro-dams the same...
drop me a PM if you want to develop a plan to annoy the hell out of them..
