Hi all.What legal consequences can I expect if I get caught fossicking or detecting outside of the set aside areas?
Got a great spot to try with a huge amount of exposed bedrock but its quite visible from the road so Ive kinda avoided it so far.
Would I get away with claiming ignorance if the DOC nazis (or god forbid Twig and Tweet) come sniffing?

You did say that is where your wife, girlfriend, lover, concubine or special friend lost her engagement ring when you were there last and you have borrowed a detector to come back to look for it didnt you? Isnt that why you are going there?

I was born devious! When in the right circumstances I am quite good at coming up with some fairly unique terminilogical inexactitudes to explain away the reasons I was somewhere or did something. Its always good to have 6001 excuses in the back of your mind to cover all eventualities.

Of course there are always the dimwitted ones who get greedy and deserve to get caught and rest assured it would not be the first time that a person has had to deny that an expensive piece of equipment was theirs and then have to stand and look like an errant schoolboy while the land owner, DOC Gestapo, council or who ever cart their gear away.

For fisheries infringements you can lose car, boat, trailer and all gear associated with the unlawful activity or the infringement committed against the fisheries regulations, with duck hunting and you lose similarly, with the carrying of a firearm on private property the firearm can be confiscated and your gun licence revoked with gold mining gear on DOC domain or private property I would think that you could stand to lose it. I did hear of a gold dredge confinscated recently but under what circumstances I dont actually know.

I'm not sure, but I believe you get your gear confiscated & a fine.

I believe they also confiscate the gold you have found that day (on you or in your gear at the time).

I just hope I'm wrong :)


I know in Whitebaiting, they take all of your gear & also visit your home & clear out the freezer of any whitebait.

Holy crap! Im all for prosecuting the idiots that take undersize paua and snapper but it seems a bit bloody excessive to take all your gold gear AND the gold!Not really in the same league is it?
And what bright spark decided to give that amount of power to a civil servant in gumboots and a shiny truck?

I was just discussing whitebaiting with Fisheries a couple of hours ago even though whitebaiting is under Dept of Constipation. Yes they can take net, screens, boards and other items used in an unlawful operation.
I do know that after having discussed my rights as a land owner with the appropriate authorities I know that I could sue for compensation for gold found by anyone on my land at a reasonable rate of renumeration and because I keep accurate records this could be quite high as the court would award that compensation at the rate we are actually finding it whether you did or did not find it but under the assumption that you were getting it at the same rate we do...whether you did or not.

This basically means that it pays to be careful and not to get ones hands too dirty. A small dredge on DOC estate or a minor infrindgement might get a verbal warning or a written warning but then again you might get some little Hitler who allows the tiny bit of authority he/she has go to their head, throwing a hissy fit at you, goes ballistic, throws the book at you and otherwise throws their toys out of the cot all because of what is, in some situations, a minor matter. Most people are good about it though. I have actually had two run ins with DOC staff who are highl qualified text book. white collar and tie experts who think they are gods gift to the world. These screw balls are not fit to actually deal with the public and when ever you come into contact with them it pays to be careful in what you say and do. If you are unfortunatley assailed by one of these socially inept dodos just be nice, yes sir, no sir and eventually they might see reason...if they dont see reason then play their game and then file a complaint about them...come to think of it if you need to file a complaint come see me - I like dealing with obnoxious Neanderthals and amoebic slime balls who developed out of a dog shit on the carpet.

The other matter is, as you all know, your rights in this country are getting severely eroded and it wont be long before you have to walk around with little meters on your chest to measure the amount of air you breath and pay accordingly! If you want real freedom go to Iraq, Afghanistan, Iran or one of those country where they are having nice wars and in between it all you can dig holes for treasure, pillage, loot, and destroy any ancient tomb or whatever for the goodies within, buy an AK47 down at the local gunshop, try it out in the main street by emptying a magazine in the air so that when Mohammod the farmer up the road gets two bullocks and himself accidentally shot by bullets dropping out of the air it is wisely and justly put down to an act of god rather than try to find someone culpable, incarcerate them plus the gun manufacturer, the sports shop owner for selling the gun and keep ten people gainfully employed for two years actually writing up reports to work out how it happened.

Anyway back to the story - it does pay to keep you nose clean and not to go where you shouldnt be or if you have to go there then be discrete, work in a manner which is easily covered up and disguised - no heavy handedness or heavy gear...and as I said earlier have a good plausible excuse...they dont have to believe it because they wont BUT it will give enough credence to give you the benefit of the doubt so that if it did go to the legal system it would caste doubt on the case...if you get my drift.

Have you actually got the right qualifications - University textbook expert, wear a white collar and tie, a totally inept ability to make a decision which is sensible, arrogant, knows all, one eyed and unable to think for yourself, on a one way track, if you read two textbooks on the same subject with contradictory information you would become so frustrated that you would commit suicide...if this is you then go for your life...you would be a great candidate for a job with DOC.

I am not anti DOC - I am just totally against some of the more 'weird' types who work for them and the decisions they tend to make

Youl see doc in fine decision makeing form i think on camble live "not shure when"...according to my brother doc wanted some new kill traps all gas operated....new design and it was supposed to be up for tender and all above board....but doc started doing funy things like starting the tender on the 24th december and giveing companys 2 weeks to design and produce a line of traps...over xmas!! odd really dont you think...but my brothers outfit already had a shiney new design all ready to go...oop,s! turns out doc had already paid 250K to some other guys and had already made up ther mind so they got a bit of a shock to learn someone actually produced something withen the time frame so it,l be interesting to see what come,s of it...hopefully someone at doc gets a good kick up the ass.
