OK so I got a call back from Robert who as it turns out is a metal detector enthusiast himself, although he is more into searching for gold than anything. He said he was not sure who it fell under but said he would go inquire with the roading people, parks people and a couple of other agencies. He got back to me and said to call the Invercargill park people.

I gave them a call and they said they interpret park law in the exact same manner as the Reserves act, in terms of metal detecting there is no issue surrounding it however any digging needs to be approved by them.

In essence if you are wanting to metal detect and recover your finds the park people would like you to email them (in Invercargills case the Invercargill based one) and Tell them where you are wanting to detect and when you are planning to head there. They cite cultural, site sensitivity and or other issues as the need for informing them of the place and time.

All in all they have been rather civil around this, even if it has taken a fair bit of ringing and foot traffic.
I'm off to request to hunt a place this weekend so I will see how it goes.

do we need to wait for a reply from them or just go?Like can you decide to go to a park , e-mail them and go at 7am on a sunday morning or do you need to plan it during the week?

I am assuming waiting for a reply, I think this current jerry rigged system they have is gong to backfire on them as well as us because they might not be able to respond to the emails in time. Any who Given my frosty encounter with them I think it best be to play it safe and play by there rules for the moment until they get fed up with responding to emails and having an automated system :P.

No deal >.< . And after the lady expressed they just needed to check if the place was sensitive or had culturally significant.

Well I guess it was fun while it lasted.............. Now I guess we are limited to places that the council does not own and that we have permission to detect on.

I wonder if I should mention how badly the lawn mowers destroy the grass.

that's pretty much what I thought.Hard case aye.Sounds like they don't know what to do , so just decieded yea na yea na.I went out a night a few times but felt a little uncomfortable doing that.
Funny thing is they have areas where you can hit a golf club and make mega diviots and the council are good with that.Or allow rugby training which can get messy at the best of times.

Many people just don't understand how popular this hobby is worldwide as there
just hasn't been the exposure in NZ.

Not really - The Police as I have said before believe there are no laws against metal detecting if you cause NO damage ........ & I never have caused any damage, so I am good to detect public lands until I am prosecuted by whomever the plonker is whom cannot see us as an asset -

Whilst you have them on email perhaps they can inform us of the contractors who are responsible for clearing refuse from our Parks & Reserves - Also ask why their lawn mowing contractors are shredding shrapnel all over sports fields and of course the mandatory banning of all cans - (or at least the pull-tabs)

Well that's just what's going to happen, there will be night hunting in the parks and they will never know.
I do it quite often, but mainly because I enjoy the peace and quiet without someone asking every 5 mins "what you looking for ?" or that group of kids looking in your plugs ready to pull the item out before you do, then asking if they can have it, can be handy getting rid of the clad though.
Can be a bit spooky at night and always having that feeling that someone will Jump you, but I'm a big guy holding a big shiny pointy digging tool and head light must put people off lol
Thank goodness we don't have the problem in ChCh but if we are not Careful it will happen

They seem fine with the detecting and you could arguably dig while no one is looking, but if they are interpreting the reserves act for parks I am wary of the 300k fines or 5-10 years prison time. I think the only thing left would be to ask an actual lawyer if they can interpret the reserves act as they see fit for something that is not a reserve. If the answer is no then they can kick up a fuss as much as they want but in a court of law, your fine.
If they can interpret it as such I guess it will come down to how much of a budget they have to throw at lawyers and of course how much the person being prosecuted can throw at one.

This of course all relies on them finding you 'Damaging' the park/reserve etc.

All in all a bunch of bollocks if you ask me, I think it is a good time to brush up on my salesmanship to sweet talk them old house owners :P .
